Artificial Intelligence Use and Product Disclaimer

This Disclaimer applies to Esterhuizen Coaching and Consulting (ECCSA) and must be read with ECCSA’s Terms and Conditions, Privacy Policy, Website Disclaimer and applicable service agreements.
1. Use of Artificial Intelligence
ECCSA may use artificial intelligence to support content development, research, analysis, report preparation, administration, technical functions, notetaking, transcription and meeting summaries.
AI supports—but does not replace—professional judgement, appropriately qualified practitioners or human oversight.
2. Professional Services
AI does not independently provide psychological services, interpret psychometric assessments, make diagnoses or make final professional decisions.
Psychological services and assessment interpretations remain under the oversight of an appropriately qualified HPCSA-registered professional. Coaching, counselling and consulting services remain subject to their applicable professional and ethical boundaries.
3. AI Notetaking and Transcription
ECCSA may use AI tools to record, transcribe or summarise meetings, coaching engagements, workshops, assessment feedback or other professional interactions.
Participants will be notified before an ECCSA-controlled AI notetaker or recording function is activated. Consent will be obtained where required. Participants may decline or withdraw consent and, where reasonably practicable, an alternative note-taking method will be used.
AI notetaking will not knowingly be used covertly.
Clients or participants may not introduce an AI notetaker, recording bot or transcription service without advance notice and the agreement of ECCSA and affected participants.
Personal information processed through AI tools is governed by ECCSA’s Privacy Policy.
4. Human Review and Accuracy
AI outputs may contain errors, omissions, bias or incorrect interpretations. AI-generated transcripts and summaries are not authoritative or verbatim records unless expressly confirmed otherwise.
ECCSA applies appropriate human oversight before materially relying on AI-generated outputs. Clients must review AI-assisted materials before relying upon, implementing or publishing them.
5. Automated Decisions
ECCSA does not use AI as the sole basis for final psychological, assessment, employment or other decisions that may substantially affect an individual.
AI-generated recommendations are treated as decision-support information and remain subject to appropriate human and professional judgement.
6. Confidentiality and Third-Party Tools
ECCSA takes reasonable steps to use AI tools in a manner consistent with its confidentiality, professional and legal obligations.
AI services may be provided by authorised third parties. The processing of personal information, including provider safeguards, cross-border processing, retention and data-subject rights, is addressed in ECCSA’s Privacy Policy.
Clients must not submit ECCSA’s confidential or proprietary materials to external AI systems without prior written permission.
7. No Warranty and Limitation of Liability
AI-assisted outputs are provided subject to the inherent limitations of artificial intelligence. ECCSA does not warrant that such outputs will be entirely accurate, complete, current, original, unbiased or suitable for a particular purpose.
To the extent permitted by law, ECCSA is not liable for loss arising from reliance on an unverified AI output, unauthorised use or alteration of an output, or a third-party AI tool introduced without ECCSA’s approval.
Nothing in this Disclaimer excludes liability that cannot lawfully be excluded under South African law.
